Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Fan Dance app and the fan.dance website (together, the "Service"), operated by Trinket Inc. ("Fan Dance", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. What Fan Dance is

Fan Dance is a platform where fans book live, one-on-one, 2-minute video sessions with individual creators. Each purchase is a single, real-time, person-to-person session between you and the creator you choose — booked as a spot within a session window and delivered live. The Service does not sell digital content, subscriptions, credits, tokens, or virtual goods. After your session, you receive a watermarked, verifiable video record of your own call.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. You are responsible for your account, for keeping your sign-in method secure, and for the accuracy of the information you provide. We may suspend or close accounts that violate these Terms.

3. Bookings and payment

• Prices are shown per session, for a named creator, before you confirm a booking.
• Payments are processed by Stripe; we do not store your card details.
• Session availability is limited; a reservation holds your spot in the session window shown at booking.
• Cancellations, refunds, and rescheduling are handled as described in our Order Policies, which form part of these Terms.

4. The session

Sessions are live conversations between two people. You agree to treat creators with respect. Harassment, hate speech, threats, sexual content involving minors, nudity, doxxing, and unlawful conduct are prohibited — in either direction. Either participant may end a call that violates these rules, and we may review reported sessions and take action, including refunds, warnings, or account termination.

5. Recordings and your license

• Every session is recorded as part of the Service. By joining a call, both participants consent to the recording.
• The video is released to you after processing and, where applicable, the creator's release approval.
• You receive a personal, non-exclusive, non-transferable license to view, download, and share the video of your own session, with its watermark, ID, and QR code intact.
• You may not remove or alter the watermark or verification marks, or use a recording to harass, deceive, or commercially exploit the creator (including advertising or endorsement uses) without their written permission.

6. Verification

Each fan dance carries a unique ID and QR code that anyone can use to confirm the video is an authentic, live-recorded Fan Dance session. Creating or distributing fake or altered "verified" videos is prohibited.

7. Creators

Creators are independent providers of their sessions, not employees of Trinket Inc. Creators agree to show up for published sessions, to follow the conduct rules above, and to the payout terms presented during creator onboarding (payouts are processed via Stripe).

8. Intellectual property

The Service, including the Fan Dance name, logo, apps, and site, belongs to Trinket Inc. or its licensors. Apart from the license in Section 5, no rights in the Service or in any recording are transferred to you.

9. Disclaimers and liability

The Service is provided "as is". To the fullest extent permitted by law, we disclaim all warranties, and our total liability for any claim arising out of the Service is limited to the amount you paid for the session giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

10. Termination

You can stop using the Service or delete your account at any time. We may suspend or terminate access for breach of these Terms. Sections 5, 6, 8, and 9 survive termination.

11. Changes and governing law

We may update these Terms; material changes will be announced in the app or by email, and continued use after the effective date constitutes acceptance. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
